Course Description

When someone goes to the United States to study or work, the question of what their family can do is just as important. The F2 visa covers dependants of F1 students, while the H4 visa covers spouses and children of H1B workers. These two visa categories have very different rules — especially around work authorisation. This course explains both clearly, so you can advise dependant visa applicants and the primary visa holders sponsoring them with total confidence.

    Module 1: F2 Visa for Dependants of F1 Students F2 visa eligibility (spouse and unmarried children under 21 of F1 students), F2 visa limitations (F2 holders cannot study full time, cannot work at all), DS160 application process, required documents (F1 student's I20, proof of marriage or birth certificate, financial proof), processing and interview at US Embassy, and managing F2 status during the F1 period.

    Module 2: H4 Visa for Dependants of H1B Workers H4 visa eligibility (spouse and children under 21 of H1B, H1B1, or H3 visa holders), H4 visa duration tied to H1B validity, DS160 application process, required documents (H1B holder's approval notice I797, proof of relationship, employer letter), and important differences between H4 issued to a spouse versus to a child.

    Module 3: H4 EAD Work Authorisation for H4 Spouses H4 EAD (Employment Authorisation Document) eligibility only available to H4 spouses whose H1B spouse has an approved I140 (Immigrant Petition), Form I765 H4 EAD application process, processing timelines, current status of H4 EAD programme (subject to policy changes verify with USCIS), and what H4 holders can and cannot do while waiting for EAD.

    Module 4: Status Maintenance, School Enrolment and Transitions Children's right to attend US public school on F2 or H4 status, transitioning from F2 to F1 if the dependant wants to study, transitioning from H4 to H1B if the dependant secures employment, maintaining lawful status when the primary visa holder changes employer or visa category, and common status mistakes that affect the whole family.
