United States

Big Alert – All Visa And Immigration Benefit Categories

What it means

Effective 5 August 2026, USCIS officers can now deny an immigration benefit request outright if the filing does not include all required initial evidence or does not establish eligibility, without first issuing a Request for Evidence or a Notice of Intent to Deny. This reverses guidance that had been in place since 2021 and restores the standard used between 2018 and 2021. It applies to nearly every benefit type, including green cards, work permits, citizenship applications and travel documents.

USCIS says the change targets incomplete or placeholder filings and will speed up decisions, but it removes the safety net that let applicants fix small mistakes after filing. The policy applies to cases already pending as well as new filings. Separately, USCIS is telling officers to request DNA testing more often in family based cases where a qualifying relationship is unclear.

Impact

Consultants must treat every filing from today as a single chance to get it right. Before submission, confirm every required document against the latest form instructions rather than assuming USCIS will ask for anything missing, and warn clients that a denial now may mean starting over and paying fees again instead of simply supplying an extra document.

United States

Active Alert – TPS Work Authorization

What it means

A Massachusetts federal court that had been shielding TPS beneficiaries from El Salvador, Ukraine and Sudan from a shortened, one year cap on their work permits was due to rule on a longer term injunction by 5 August, and current reporting confirms the shortened validity period is now able to proceed for that group. TPS itself remains valid for El Salvador through 9 September and for Ukraine and Sudan through 19 October, but the separate 540 day automatic extension that had protected some work permits is no longer guaranteed while the underlying case continues.

Separately, USCIS again extended Somalia TPS work permits, this time through 10 August, continuing the short rolling extensions issued since the Supreme Court's June ruling in Mullin v. Doe.

Impact

Consultants with El Salvador, Ukraine or Sudan TPS clients should check each employee's individual EAD category and filing date immediately, since eligibility now depends on case specific facts rather than a blanket extension. Somali clients have a firm new date of 10 August to track, and employers should not assume any TPS work permit is automatically valid without checking the current USCIS guidance page first.

United States

Big Alert – Immigrant Visa

What it means

The State Department has launched a pilot allowing consular officers to require certain immigrant visa applicants who were found inadmissible on public charge grounds to post a bond with USCIS, worth up to 250,000 dollars, as a way to still receive their visa. The pilot initially applies to applicants from the Dominican Republic and follows the January 2026 suspension of immigrant visa processing for nationals of 75 countries pending a review of public charge screening.

A separate nonimmigrant visa bond pilot for B-1/B-2 applicants from 50 countries, which ran from August 2025 to 5 August 2026, has now been made a permanent program with increased bond amounts.

Impact

Consultants with clients from the Dominican Republic facing a public charge finding should discuss the bond option as an additional pathway, not a guarantee, and confirm current financial documentation is airtight before relying on it. Clients from any of the 50 countries under the nonimmigrant bond program should be told this is no longer temporary and must be factored into every US visitor visa budget and timeline.

United Kingdom

Breaking – Global Talent Visa

What it means

The Home Office announced today that more than 100 UK companies, including major names in life sciences, clean energy and engineering, can now support Global Talent visa applications for exceptional researchers working on funded projects. This endorsed funder pathway was previously open mainly to universities and academic research bodies, so this is the first time commercial research businesses can bring in top international scientists and engineers through the route.

Impact

Consultants should flag this route to researcher and scientist clients who have job offers from UK research intensive businesses but do not fit standard Skilled Worker criteria, since Global Talent offers faster settlement and no sponsor tie to a single employer. Interested organisations must register with UKRI to become an approved host before their researchers can benefit, so employer side clients should start that registration now rather than waiting for a candidate to appear.

Canada

New IRCC Update – Ontario PNP

What it means

Ontario's Ministry of Labour, Immigration, Training and Skills Development opened the Expression of Interest portal for its new Ontario Workforce Priority stream on 4 August, ending a five week gap since the province retired its previous eight nomination streams in June. The new stream covers three pathways: higher skilled workers, lower skilled workers, and self employed physicians, each linked to a qualifying Ontario job offer.

Impact

Consultants with clients who held an old, unused Expression of Interest under the previous Ontario streams should know those were automatically withdrawn and must register fresh under the new system. Employers and candidates who have been waiting since late June can now submit, but should review the new scoring factors carefully since they differ from the previous point system.
