United States · October 2026 Visa Bulletin
China EB-5 Filing Date Jumps Four Years as Worldwide EB-2 Retrogresses
● Big Alert

The Department of State published the October 2026 Visa Bulletin late on 29 September, ending days of unusual delay and opening Fiscal Year 2027 with sharp movement in both directions. The headline win is China EB-5 unreserved, where the filing date leaps roughly four years while the final action date stays put at 1 December 2016.

EB-1 India, unmoved again

India EB-5 unreserved also reopens, letting a long stalled queue move. Against that, worldwide EB-2 and EB-3 retrogress from current to fixed cutoffs to keep spending inside the new fiscal year.

USCIS has confirmed it will honour the Dates for Filing chart for all employment based adjustment applications throughout October, so Form I-485 can be lodged even where the final action date has not yet caught up.

What it means for you

Windows like the EB-5 India and China openings have historically closed fast, which puts a premium on clients with 2016 to 2023 priority dates moving now rather than after the next bulletin. The opposite discipline applies to worldwide EB-2 and EB-3: anyone who was filing against a current chart last month needs the retrogressed cutoff checked against their priority date before anything is submitted. EB-1 India offers nothing to act on this month beyond keeping documentation current.

Portugal · Immigration Law 62/2026
Regularisation After Arrival Closes, 90 Day Decision Clock Begins
● Big Alert

Portugal's Law Number 62/2026, in force since 11 September, has completed its initial administrative rollout as the month closes. The law shuts the older regularisation pathway that let some undocumented foreign residents obtain status without a prior visa, and formalises a decision window for residence permit applications.

90 days
Statutory decision window for residence permit applications
+30 days
Extension available for complex cases

Students at secondary and Level 4 course level stay eligible for residence permits, provided they hold the required residence visa, enrolment and health cover. The law also transposes EU directives on international protection and work authorisation into Portuguese law.

What it means for you

Any Portugal strategy that assumed entry without a visa followed by regularisation on the ground no longer has a legal route behind it, so the correct entry visa has to be in hand before travel. The 90 day clock cuts the other way and works in the client's favour: a lapsed window without a decision creates a clean paper trail, which makes tracking the date and following up with AIMA the moment it passes a genuinely useful discipline rather than administrative fussiness.

Canada · Express Entry
Third Straight CEC Draw With a Falling Cutoff, Now 518
● Update

IRCC ran Express Entry Draw Number 446 on 29 September, issuing 2,000 invitations to Canadian Experience Class candidates at a CRS cutoff of 518, one point below the 15 September draw. That makes three consecutive CEC draws with a falling cutoff, a clear downward path from the August peak of 523.

518
CRS cutoff, Draw Number 446
2,000
Invitations issued on 29 September
55,250
CEC invitations year to date, seventeen rounds

Scores across those seventeen rounds have run between 507 and 523. Category based draws for healthcare, trades and French language remain on the calendar for early October.

What it means for you

A steady one point drift means a candidate sitting five points below today could be at cutoff within two draws, which changes the calculation for anyone thinking of pulling a profile out of the pool. For CEC candidates in the 510 to 517 band, the levers that still move a score inside that timeframe are an updated ECA, a language retake where a marginal band gain is realistic, and a provincial nomination where an offer already exists.

European Union · Entry Exit System
Biometric Border Registration Turns One on 12 October
● Reminder

The EU's Entry Exit System reaches its first anniversary on 12 October, having gone live at Schengen external borders on that date in 2025. The phased rollout is now largely complete across land, sea and air crossings, and travellers from visa exempt third countries, India, Brazil, Argentina and the UK among them, have been recording biometrics on first entry for close to a full year.

3 years
Rolling cycle before biometrics are captured again
Q4 2026
ETIAS full operation target, into early 2027

The ETIAS travel authorisation timeline remains subject to final Commission confirmation.

What it means for you

A recurring client question is whether biometrics get taken every trip. They do not: registration is a one time step on first entry within each rolling three year cycle, with later entries handled by facial matching at automated gates. The practical caveat for October and November travel is the land crossings, where queues have run longest since the anniversary uptick in tourism.

United States · DV-2028 Lottery
Registration Opens Early October as DV-2027 Selection Closes
● Update

The State Department confirmed the DV-2028 Diversity Visa Lottery registration window opens in early October at dvprogram.state.gov, following the standard annual cycle. The DV-2027 selection process closed on 30 September, so selectees who have not been notified through the Entrant Status Check should now assume they were not selected.

Valid passport number required
Mandatory at submission, in line with the rule introduced two selection cycles ago
What it means for you

Portal problems cluster in the final week of the registration window every year, which makes the first week of October the quiet time to submit clean entries rather than the last. The detail most often missed is passport validity: a passport that expires mid cycle is awkward to correct in the entry record, so checking validity through 2028 before submitting saves a problem that has no easy fix later.

United Kingdom · Immigration Rules HC 584
One Week Left to File Under the Current Rules
● Update

The Home Office statement of changes HC 584 takes effect at 15:00 UK time on 8 October. The main tranche covers introductory definitions, Part 1, Suitability, Appendix A, Administrative Review, and revised visitor and student provisions, with transition protection for applications lodged before that moment.

30 Nov

9 Dec

What it means for you

A fixed clock time rather than a date makes 8 October unusually literal, so student and visitor files that do better under the current rule set are decided by the hour they are lodged, not the day. Religious Worker applications that cannot meet the incoming supernumerary or religious order tests face the same shape of decision with a 29 October edge. EU Settlement Scheme family permit files have the longest runway and the least excuse for a late scramble, given the December documentation update is already published.

Pro tip for consultants

When a Visa Bulletin carries retrogression and advancement in the same edition, resist reacting to the headline either way. Read every category your case load actually touches. One client can lose ground while a colleague at the next desk, holding a different priority date, moves months forward on exactly the same day.
