Proposed 70,000 Dollar OPT Fee Lands Alongside Eight PERM Suspensions
● Big Alert

The Department of Homeland Security has proposed an Optional Practical Training fee of 70,000 dollars per F-1 student for an initial OPT recommendation, with 30,000 dollars for later requests. Universities would be responsible for payment. The fee would apply only to recommendations made after the rule takes effect, comments close on 9 November, and legal challenges are expected the moment it is finalised.

Separately, the Secretary of Labour has suspended Microsoft, Adobe, Cognizant, Infosys, Tata, Wipro, HCL and Capgemini from the PERM labour certification program, halting all new and pending applications from these eight employers for an unspecified period.

The administration also opened investigations into alleged J-1 visa fraud at nine universities, Harvard, Yale, Stanford and MIT among them, with subpoenas served and a dedicated visa fraud strike team being formed.

What it means for you

If the OPT fee survives, the economics underpinning US STEM employment for international graduates change entirely, which makes it a conversation worth having with F-1 clients now rather than after the rule is final. PERM is the first step in the employment based green card chain, so the suspension at those eight employers blocks everything downstream, and affected staff need contingency timelines rather than reassurance. Students at the flagged universities sit in a different category of risk: any J-1 case tied to a programme under subpoena will draw heightened scrutiny, and counsel is better engaged early than mid investigation.

United States · Refugee Status Termination
Response Window on Termination Notices Drops From 30 Days to 10
● Big Alert

A USCIS interim final rule, scheduled for Federal Register publication on 14 October, cuts the response period for Notices of Intent to Terminate refugee status from 30 days to 10. It applies to people admitted as refugees whom DHS later concludes did not meet the refugee definition at the time of admission.

13 days

Weekends and federal holidays count

Missing the deadline can lead to automatic termination without rebuttal, loss of refugee based employment authorisation and removal consequences.

What it means for you

Because weekends count, an unopened envelope can swallow a third of the window before anyone reads it, which turns same day intake on every NOIT from good practice into the difference between a rebuttal and an automatic termination. A prepared template response packet, including requests for interview and oral testimony, is what makes it possible to answer inside ten days when the client is travelling, unwell or simply unreachable for a few days.

United States · Deference Policy and EADs
Every Extension Petition May Be Judged From Scratch Again
● Update

The administration has again proposed eliminating the longstanding USCIS policy of deferring to prior approvals when adjudicating H-1B, L-1 and other nonimmigrant worker extension petitions. Officers would reassess eligibility from scratch on every renewal.

540 day cap removed
USCIS reaffirms the regulation ending the automatic EAD extension that had covered renewal gaps

That automatic extension had served as the main safety net for workers waiting on an EAD renewal.

What it means for you

An extension packet assembled on the assumption that a prior approval carries weight is now a thin packet. H-1B and L-1 renewals need building to initial petition standard, with the full evidentiary record rather than a reference to what was approved last time. On the EAD side, the safety net that quietly absorbed processing delays is gone, so filing as early as regulations allow and planning for a possible employment gap are now two separate necessary steps rather than one cautious one.

Canada · October Processing Times
US Work Permits Triple to Six Weeks as Citizenship Climbs Again
● Update

IRCC's October release moves in both directions. Work permits from the United States tripled from two weeks to six. Citizenship certificates rose another month to 34. Against that, PR card new issuance improved four days to 33 days, and the CEC queue fell by roughly 5,000 to 53,900 while holding at six months.

370 days
Visitor record extensions, improved 33 days and still the worst
100 days
Nigeria visitor visa, up 16 days
30 days
India visitor visa, down one day

Non Express Entry PNP sits at 13 months and the Federal Skilled Worker Program climbed to seven. Super Visa times for Pakistan fell 31 days to 101, while the Philippines rose 26 days to 90.

What it means for you

A tripling on US work permits is the kind of movement that invalidates quoted timelines rather than stretching them, so six weeks is the new baseline for any American client in the pipeline. Nigerian visitor clients now need the longest runway in the system at over three months, while Indian clients remain at the fast end. Citizenship is the conversation nobody enjoys: at 34 months the certificate wait has grown again, and saying so plainly is kinder than letting a client discover it in month twenty.

GCC / European Union · Schengen Visa Waiver
Riyadh Summit on 24 October Could Start the Waiver Process
● Reminder

The second EU GCC Summit takes place on 24 October in Riyadh, and the Gulf Cooperation Council Secretariat has signalled that a major announcement is expected on starting the process to waive Schengen visa requirements for citizens of Saudi Arabia, Qatar, Oman, Bahrain and Kuwait. The UAE already holds visa free Schengen travel for short stays.

Saudi Arabia · Qatar · Oman
Bahrain · Kuwait
The five GCC states covered by the expected announcement

A waiver process would still take time once formally initiated, but a confirmed start alone would be the biggest shift in Gulf European mobility in years.

What it means for you

For Saudi, Qatari, Omani, Bahraini and Kuwaiti clients weighing a multi year Schengen multiple entry application, the economics change completely if the waiver process begins, which makes the nine days before the summit worth waiting out. The opposite holds for anything imminent: travel in the next six to twelve months still needs the current visa, and pausing those filings on the strength of an expected announcement would be a costly reading of a signal that is not yet a decision.

Germany · Border Controls and Asylum
Internal Schengen Checks Now Set to Continue Indefinitely
● Update

Interior Minister Alexander Dobrindt confirmed that temporary internal Schengen border controls, in place since September 2025 and extended through late 2026, will remain in force indefinitely. Fresh data from the Federal Office for Migration and Refugees shows asylum applications have fallen to a decade low in 2026 while deportations have risen sharply.

What it means for you

Indefinite means this stops being a temporary disruption to plan around and becomes a permanent feature of road and rail travel into Germany. On the spot checks have increased, and a residence card or visa stored on a phone is not the same as one in a pocket, so staff sent on short cross border trips need the physical document with them.

United Kingdom · HC 584 In Force
Second Week of the New Rules, With Three Tranches Still Ahead
● Reminder

The main tranche of UK Immigration Rules changes under HC 584 took effect at 15:00 UK time on 8 October and is now in its second week. It covers introductory definitions, Part 1, Suitability, Appendix A points scoring, Administrative Review, and revised visitor and student provisions. Transition provisions preserve the prior rules only for applications validly lodged before that moment.

What it means for you

Every student and visitor case now goes in under the new rule set, so the transition question is closed. What remains live is 29 October: any Religious Worker case that cannot meet the incoming supernumerary or religious order criteria has two weeks of the current rules left, and clients in that position benefit from knowing it today rather than on the twenty eighth.

Pro tip for consultants

When a government shortens a response deadline, as the US did this week by cutting the refugee NOIT period from 30 days to 10, the intake protocol needs updating the same day. A client who received a notice on a Friday once had a comfortable month. Under the new rules that same client can be in default by the following Monday if nobody opens the mail over the weekend.
