United States

Big Alert – Advance Parole, All Adjustment Categories

What it means

The Board of Immigration Appeals ruled on 13 August, in Matter of Delcarmen-Lara, that leaving the United States on advance parole now counts as a departure under the law that triggers the three and ten year unlawful presence bars. This overturns Matter of Arrabally and Yerrabelly, a 2012 decision that had protected pending adjustment applicants, DACA recipients and others from this exact risk for more than a decade. The ruling applies going forward only, not to trips already taken.

Anyone who accrued more than 180 days of unlawful presence before travelling on advance parole can now face a three year bar, and anyone with a year or more can face a ten year bar, simply for leaving and returning under a document that was previously considered safe.

Impact

Consultants must stop advising clients that advance parole travel is automatically safe. Before anyone with any history of unlawful presence books international travel on advance parole, calculate their accrued unlawful presence precisely and get individualized legal advice, since a routine trip could now trigger a bar that blocks return to the US for years.

United States

Big Alert – TPS Work Authorization

What it means

USCIS terminated Temporary Protected Status for Somalia effective 14 August, meaning Somalia TPS work permits are no longer valid and employers must reverify affected employees immediately. Separately, USCIS extended the validity of Ukraine and Sudan TPS EADs for renewal applicants through 19 October, giving those two groups more runway than Somalia received.

Impact

Consultants with Somali TPS clients should treat this as an immediate loss of work authorization, not an upcoming one, and advise employers to reverify status today. Ukraine and Sudan renewal applicants have breathing room through October, but should still file as early as possible given how often these dates have shifted this year.

United Kingdom

Update – Asylum And Immigration Appeals

What it means

The Home Office confirmed on 14 August that a new 24-week target for deciding asylum and immigration appeals applies to in-scope cases submitted to the First-tier Tribunal from 12 August, covering non-detained foreign national offenders and people receiving asylum support and accommodation. The current average wait for a decision is 67 weeks, and the government expects the change to save an estimated 6.9 billion pounds by reducing time spent in taxpayer funded accommodation and speeding up removals of unsuccessful appellants.

Impact

Consultants with clients whose appeals fall into these categories should prepare cases faster and more thoroughly from the outset, since the compressed timeline leaves less room to gather additional evidence after an appeal is lodged. Confirm whether a case actually falls in scope before assuming the new timeline applies, since this targets specific categories of appeal, not all asylum claims.

Canada

Update – Processing Times

What it means

IRCC's processing time data released on 10 August shows citizenship certificate processing has reached 25 months, up six months in a single reporting cycle, with the queue growing to roughly 121,800 people. Visitor record extensions also spiked sharply to 316 days. On the positive side, the Federal Skilled Worker Program improved to six months and Canadian Experience Class queues shrank slightly.

Impact

Consultants with clients needing a citizenship certificate for a passport application, employment, or other purpose should warn them the wait now runs over two years and plan accordingly. Clients extending a visitor record should file as early as legally possible given the sharp jump in that specific processing time, and should not assume last year's figures still apply.

United States

Active Alert – African Visa Processing

What it means

The State Department's realignment of routine visa processing across Africa from nearly 50 posts to 20 regional hubs, effective since 1 August, is continuing to generate scrutiny from immigration advocates who say the change will cause months of delays, family separation, and workforce disruption for applicants who no longer have a local post. Citizens of non hub countries must now travel, sometimes across a border, to reach an approved hub for a routine visa interview.

Impact

Consultants with African clients applying for any US visa category should confirm whether their client's country still has local processing or now requires travel to a hub, and factor in the extra cost, time, and logistics of cross border travel when setting expectations for the whole process.

Russia

Update – Skilled Worker Routes

What it means

Russia's merit based Talent Visa, active since April and requiring no language test or quota allocation, has attracted more than 4,000 registered applicants so far. Reporting today confirms a law signed 26 July will nearly triple the salary threshold for the standard Highly Qualified Specialist visa from 1 March 2027, rising from roughly 250,000 rubles to about 717,000 rubles a month, pushing many employers toward the Talent Visa as an alternative route for bringing in skilled staff.

Impact

Consultants with clients or employer partners considering Russia should evaluate the Talent Visa now as the more accessible option for scientists, entrepreneurs, engineers and other qualifying professionals, and warn any client currently planning around the standard HQS route that its cost will rise sharply from March 2027.
