The common thread today is process rather than eligibility. Australia has added a step, Italy has opened a window that closes on a fixed date, and Canada is about to recalculate a score nobody can predict yet. None of these change who qualifies. All of them change when a file has to move.

IN EFFECT | BIOMETRICS | 26 OCTOBER
|
Biometric collection widens for visa applicants in India
From 26 October, the Australian Department of Home Affairs has widened biometric collection for people applying from India. Many new applications lodged on or after that date now need fingerprints and a facial photo before a decision is made. Applicants receive a formal biometric request from Home Affairs, usually by email, and can then give biometrics at one of the Australian Biometrics Collection Centres across India run by VFS Global. Some applicants may be allowed to use the Australian Immi App instead of visiting a centre.

Countries where Australia already collects biometrics
|
Visas already granted, and applications lodged before 26 October, are not affected. India is simply being brought into line with the wider system Australia already operates.
The sequence matters more than the requirement itself. The biometric request letter comes first, and a centre visit booked before that letter arrives achieves nothing. One to two extra weeks is a realistic buffer on visitor, student and family timelines, and more for clients living far from a collection centre. Optional premium services sold at the centre do not speed up processing or improve the outcome, and saying so at the start prevents a difficult conversation later.

NEW | WORK VISA QUOTA | 23 OCTOBER
|
Decreto Flussi 2027 opens with 165,850 work visa places
Italy's Interior Ministry opened the prefilling stage for the 2027 Decreto Flussi on 23 October. This is the yearly quota system that lets Italian employers hire workers from outside the EU. A total of 165,850 entries are planned for 2027.
|
89,000
Seasonal jobs in agriculture and tourism
|
76,200
Non seasonal jobs, including 14,000 for family and home care
|
650
Places for self employed applicants
|
Prefilling runs until 7 December on the ministry portal, with a short window from 9 to 13 December to finalise forms. Prefilling is not the actual submission. The real applications go in on click days.
| Click Day | Category |
|---|---|
| 12 January 2027 | Seasonal work, agriculture |
| 9 February 2027 | Seasonal work, tourism |
| 16 February 2027 | Non seasonal work |
| 18 February 2027 | Family and home care workers |
This is one of the most practical routes into Europe for skilled and semi skilled workers from India, Bangladesh, Sri Lanka and Pakistan, and it only works through a real Italian employer. Prefilling is employer work and it needs to happen now, because places on click day are taken within minutes. The claim that an agent can book an Italy work visa for a client is false in every version it appears. Without a genuine employer filing on click day, there is no application at all.

UPDATED | IMMIGRANT VISAS | COURT ORDER FOLLOW UP
|
Court win has not released most visas stuck in the 75 country pause
A federal court ruled in August, in CLINIC v. Rubio, that the State Department's immigrant visa pause for nationals of 75 countries was unlawful, and ordered refused cases to be looked at again. New reporting this week shows how slow the recovery is.
|
43,000+
Applications refused only because of the pause
|
706
Cases decided again between 21 August and 30 September
|
318
Of those that ended in a visa
|
The other 388 were refused on different legal grounds. The court set no deadline, and the government says each case must be reviewed one by one with no fixed timeline.
A ruling in a client's favour is not a visa. The first thing to establish on any affected file is whether the refusal rested on the pause alone or on a second ground as well, because only the first group benefits directly. Document requests and interview notices in these cases are time sensitive. Where delays run very long, a US immigration attorney is the right person to assess whether a mandamus action fits. Financial evidence prepared in advance is worth having, since public charge and other grounds are appearing during review.

UPDATED | EXPRESS ENTRY | 26 OCTOBER
|
Draw 451 lands days before the Express Entry scoring reset
IRCC held Express Entry Draw 451 on 26 October, inviting 792 Provincial Nominee Program candidates with a minimum CRS score of 761. It comes just days before 3 November, when points for high wage occupations begin, an LMIA is no longer needed for job offer points, and every profile in the pool is rescored.
|
792
Invitations issued to PNP candidates
|
761
Minimum CRS score in this round
|
2 weeks
Maximum pause in rounds while scores are recalculated
|
A profile that is not updated before 3 November carries its old information into the new scoring, so a qualifying job offer only counts from day one if it is already on the profile. The first half of November is likely to be quiet, and that quiet is scheduled rather than a signal of anything. Once draws restart, cutoffs may look nothing like the current ones, which makes score predictions worthless until the first new round has published.

United Kingdom
REMINDER | SETTLEMENT | 26 OCTOBER
|
Prime Minister backs earned settlement, but the rules are still not final
On 26 October, Prime Minister Andy Burnham said he agrees with the principle that settlement in the UK should be earned through contribution. He did not commit to every part of Home Secretary Shabana Mahmood's plan, which proposes moving the default wait for Indefinite Leave to Remain from five years to ten, with longer periods for some groups, including 15 years for lower skilled roles such as care work. More than 100 Labour MPs and major unions oppose the care worker change, and concessions for health and care staff are being discussed.
No Immigration Rules have changed yet. The government says the final policy will come through a Statement of Changes before February 2027. The only confirmed change is that the English requirement for settlement rises from B1 to B2 on 26 March 2027.
The rules in force on the day an application is submitted are the rules that decide it, which is why the current five year route is still the route for Skilled Worker and Health and Care clients. Care workers approaching five years gain from having documents ready so they can file the moment they qualify rather than after a change lands. B2 English is the one part of this that is already certain, so preparation can begin now without waiting for the Statement of Changes.

Chile
UPCOMING | EXPULSION LAW | 20 OCTOBER
|
Congress passes a tougher expulsion law
Chile's Congress gave final approval on 20 October to a law that speeds up expulsions of migrants without legal status. Police can ask a judge for permission to enter a home to detain someone who has a final expulsion order. President José Antonio Kast still needs to sign it, and it must be published before it takes effect.
|
5 years
Minimum ban on returning after an administrative expulsion, up from three
|
5 days
Time to challenge an expulsion in court, down from ten
|
People holding valid Chilean residence are not the target of this law. The exposure sits with anyone whose status has expired or was never regularised, and a five day appeal window leaves almost no room to react once an order is issued. For clients in Chile, confirming that every permit and renewal is current has moved from housekeeping to a time sensitive check, and anyone already in an irregular position needs legal advice inside Chile rather than general guidance.

Netherlands
UPCOMING | SPONSOR COMPLIANCE | 1 NOVEMBER
|
A softer first step for sponsor mistakes from 1 November
From 1 November, the Dutch immigration service IND will run a one year pilot for recognised sponsors. For certain reporting and record keeping slips, such as late notice of an expiring residence permit, the IND may first contact the employer, hold an information session or call a compliance meeting before giving a warning or a fine. Fraud, abuse and serious misconduct are not covered.
Employers hiring Highly Skilled Migrants or EU Blue Card holders gain a margin for small administrative errors, and nothing more than that. The reporting duties themselves are unchanged, so permit expiry dates and address changes still need reminders set well in advance. A pilot also has an end date, which makes this a year of tolerance rather than a new standard.

REMINDER | REGULATORY CALENDAR | THIS WEEK AND NEXT
|
Lottery instructions, two comment deadlines and a fee still blocked
The State Department must publish DV 2027 lottery instructions by 29 October, with registration opening on 1 November under a court order. Public comments close on 10 November for the proposal to remove the 60 day grace period for laid off visa workers, and on 13 November for the proposal to end USCIS deference to earlier H-1B, L-1, O and TN approvals. The 100,000 dollar H-1B fee remains blocked by the courts.
Entry to the DV lottery is free and the official State Department website is the only legitimate entry point, which is worth repeating to clients every year, because fake lottery sites appear within hours of the instructions going live. On the employer side, the deference proposal is the one that changes daily practice: if it goes through, an extension stops being a formality and becomes a fresh case, so evidence assembled once will need assembling again.

Put the new step on the timeline the day it appears
When a process gains a step, such as a biometric request or a click day, it belongs on the client's written timeline immediately rather than at the point it becomes urgent. Most complaints this week will not come from refusals. They will come from clients who did not know a step existed until it delayed them.
One line in the client checklist does the work: what the step is, who triggers it, and how much time it adds. That line saves hours of explaining later, and it is also the clearest record that the file was handled properly if anyone asks afterwards.
